Aura Sweepstakes OFFICIAL RULES GAME OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, 13 AND OLDER US LAWS GOVERN THIS GAME VOID IN PUERTO RICO AND WHERE PROHIBITED 1. NO PURCHASE NECESSARY. A purchase will not increase your chances of winning. 2. Game Timing/Description: The Aura Miami Getaway Sweepstakes and Instant Win Game (the "Game") begins 12:01 AM ET 1/1/08 & ends 11:59:59 PM ET 10/31/08 ("Promotion Period"). Fifty (50) First and two hundred and fifty (250) Second Instant Win Prizes will be randomly seeded among online game plays throughout the Promotion Period. In addition, a random drawing performed at the end of the Promotion Period will award One (1) Grand Prize. 3. How to Play the Game: You must have an Aura Instant win game card. To play the Game, go online to www.aurarunning.com any time during the Promotion Period, and click on the promotion/events icon and complete the registration page including the special code number on the back of your Instant Win game card, then click submit. Instant winners will be randomly chosen based on a predetermined number selection system. If you receive a winning game play, you will be told online how to claim your prize. To win the Grand prize, players will have to first register their card online then bring the card with the back portion completely filled out to a local Aura retailer. The retailer will submit the card to us and you will then be automatically entered into the random drawing. Game play must be completed during the Promotion Period in order to be valid. Proof of play and/or winning will not be deemed to be proof of play and/or winning by Sponsor. Limit one online instant win game play per player. Use of any automated entry software is prohibited. Online game plays made with multiple e-mail addresses, under multiple identities or through the use of any agent or other device or artifice to play multiple times will be deemed invalid. Aura assumes no responsibility for incorrect or inaccurate entry information, human error or technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any computer equipment or software, or any combination thereof, or for lost, stolen, late, illegible, misdirected, entries or mail. If a dispute results as to the identity of an online participant, it will be determined that the online game play was submitted by the authorized account holder of the email address from which the entry is made. For these purposes, the authorized account holder is the natural person assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address. Aura will collect information from the entrant for the purpose of notifying winners and awarding the prizes as well as to notify entrants of other upcoming offers and promotions that the company may be running. Aura will never share this information with any third parties. 4. Eligibility: Open to legal residents of the 50 United States and the District of Columbia, 13 years of age or older at time of entry. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), and the respective household members, of Aura, its affiliates, subsidiaries, divisions, agents, individuals engaged in the development, production or distribution of Game materials, advertising and promotion agencies, are not eligible to participate. Game is subject to all federal, state, and local laws. U.S. law governs this Promotion. Game is void in PR & where prohibited, taxed or restricted by law. Aura reserves the right to disqualify participants who violate these Official Rules or interfere with this Game in any manner. If a participant is disqualified, Aura reserves the right to terminate that participant's eligibility to participate in the Game. 5. Prizes/Odds of Winning: Random Drawing Prizes: (1) Grand Prize: A 4 day/3 night trip for 2 to Miami, FL to attend the ING Miami Marathon in January 2009. Prize includes round trip coach class air transportation from the major airport nearest the winner's home to Miami, hotel accommodations (double occupancy), airport/hotel transfers, and registration to the marathon (if participation is desired),. Approximate retail value ("ARV"): $2,500. (50) First Prizes: Aura Footwear. ARV: $80 – 120. per pair depending on style. Odds of winning a random or Instant win drawing prize depend upon the number of entries received throughout the Promotion Period. Total value of all prizes approximately $8,750. Odds of winning an Instant Win Prize is 1:1,667. Odds based upon an estimate of 500,000 total game pieces printed and transacted during the Promotion Period; actual odds of winning will depend upon the number of game plays transacted. 6 Prize Restrictions: All prizes (except Grand Prize) will be awarded within 4-6 weeks after the Promotion Period ends (subject to Aura’s verification of eligibility). Actual ARV of trip prize may vary based on winner's point of departure and existing rates at time of travel. Final travel arrangements and choice of hotels to be determined by Aura in its sole discretion. Guests who are minors must be accompanied by parent/legal guardian. Winner and guests or parent or legal guardian of minor guest must sign a travel release prior to traveling. Trip prize must be taken in January 2009 or prize will be forfeited and an alternate winner may be selected. Travel subject to availability and confirmation of reservations, certain travel restrictions and blackout dates may apply. The trip may not be combined with any other offer. Winner and guests must travel on the same itinerary at the same time. Winner and guests must possess a valid ID in order to travel. Winner and guests are responsible for obtaining travel insurance (and all other forms of insurance) where applicable, at their option, and hereby acknowledge that Aura has not and will not obtain or provide travel insurance or any other form of insurance. If any part of the trip's itinerary is unable to take place as planned, for any reason, beyond the control of the Aura, including but not limited to, cancellation, scheduling conflicts, political conflicts or war or an event of force majeure, the remaining components of the prize will be awarded Auras obligation to the winner will be fulfilled, and no other additional compensation will be provided. Prizes are non-transferable; no substitutions allowed except by Aura due to unavailability, in which case substitution will be of equal or greater value. Limit one prize per individual/household. All applicable taxes and any other costs not specifically stated herein are responsibility of the winner. 7. Random Drawing: A random drawing will be conducted on or about November 1, 2008 to award the Grand Prize. A participant is automatically entered in the Random Drawing when they complete and submit the online registration form during the Promotion Period and bring it to a local Aura retailer. All entries become the property of the Aura and none will be returned. Winners will be selected in a random drawing by an independent judging organization, from among all eligible entries received. Each random drawing entry will have an equal chance of winning. Winners will be notified by U. S. mail. Decisions of the judges will be final and binding on all matters relating to this Game. Unclaimed Prizes will not be awarded. 8. Tell-A-Friend: You can earn additional entries in the Random Drawing by telling your friends about this promotion. After you play the Game, you will be given the opportunity to send an email to up to 10 friends telling them about the promotion. For each person with a valid and unique email address that comes back to the site and registers for the promotion, you will receive one (1) additional entry in the Random Drawing. You may earn a maximum of 10 additional entries in the Random Drawing. 9. How To Claim a Prize: Instant winners will receive immediate notification online after they play the Game if they have won a prize. Winners should print out the winning game play message for their files. Second prize winners will be notified/confirmed by mail. Prizes won will be automatically sent to the address indicated on the registration form. No other action is required by the winner. Prizes will be delivered within 6-8 weeks. Limit one prize per person. 10. Winner Notification and Verification: Potential online instant winners will receive immediate notification online. Winner confirmation is subject to verification and compliance with these Official Rules. Potential winners of Grand, First and Second Prizes will be notified by mail, and will be required to sign and execute an affidavit of eligibility and liability release and where legal, a publicity release and federal and state tax release, and return same, properly executed, within 14 days of issuance of notification. Failure to return any or all documents as specified, a prize or prize notification being returned as undeliverable, or potential winner not complying with any term of these Official Rules will result in the participant being disqualified and the prize may be awarded to a potential alternate winner. 11. Conditions of Participation: By entering, entrants agree to be bound by these Official Rules & the decisions of the judges, which are final. All materials submitted in connection with the Game become the property of the Aura and will not be returned. By participating, winner consents to the use of his/her name, image, likeness, photograph, voice and biographical material for advertising, publicity and promotional purposes by Aura, or a party designated by the Aura, in any and all media now or hereafter known including but not limited to, any online announcements, or for sharing this information with the press for viewing, whether TV or print, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law. Entrants release and hold harmless Aura, its affiliates and agencies and each of their respective employees, officers, directors and shareholders ("Releasees") from any claims, actions, injury, loss or damage of any kind, including but not limited to, personal injury or death, resulting from participating in this Game or from the acceptance, possession, or use or misuse of any prize awarded or participation in any prize-related activity. 12. Number of Prizes: No more than the listed number of prizes will be awarded. In the event of an error, or for any other reason, the number of winning game plays distributed for any prize level exceeds the number of prizes listed for that level; Aura reserves the right to conduct a random drawing from among eligible prize claims received to award the listed number of prizes. In the event of an error, including but not limited to, printing, production, seeding, technical, computer or human error, or for any other reason, the number of winning game plays distributed or received for any prize level exceeds the number of prizes listed in herein for that level, Aura reserves the right to conduct a random drawing from among all non-suspect eligible prize claims received to award the listed number of prizes for that level. 13. Internet: If for any reason this Game is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Aura which corrupt or affect the administration, security, fairness, integrity or proper conduct of this game, the Sponsor reserves the right at its sole discretion, to void any entries or Game plays at issue, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Game and/or sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Releasees assumes no responsibility for incorrect or inaccurate transcription of entry information, or for any human or printing error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, delay in operation or transmission, line failures of any kind including computer equipment, software, inability to access any online service or web site, inability to submit the online registration form, or any other error or malfunction, or for destruction or unauthorized access to, or alteration of, entries, or for late, lost, stolen, illegible or misdirected entries. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME/SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, AURA RESERVES THE RIGHT TO CANCEL THE PROMOTION AND/OR SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
